My 6th year of H1b is expiring in the Sep 26, 2008. I already applied for my H1b renewal and already got the receipt. I'm Eb3 - ROW.

My and my wife also applied for our EAD renewal in jun 1, 2008 (Nabraska). didn't receive anything till now. My wife needs that to continue with her job, we already expedite the process last week.

I also visited home couple of months and and entered Us using my AP.

I have some question regarding all those issues:

1) Can I get a business license when i'm working with the H1b and have the EAD?

2) Does it going to have any effect on my green card process or H1b status?

3) If i have the problem then can i open the business license under my wife's name as she will be in the EAD.

4) My PD is May 2006. Any chance it will be current in next 6 months?

I am planning to schedule a visa appointment soon. I was filling DS-156 form
and have a following question:

Item#36 : "Has anyone ever filed an immigrant visa petition on your Behalf?".

Here is my situation:

Myself -> H1B
My wife, kid -> H4

Applied for I-485 last year ( all 3 of us ).

Question:

For me, I understand that I say "yes" and mention name of my employer.
But for my wife+kid, I say "yes", but what should I fill for "who" part?

Also, Item#33 for my kid (2nd grade), should answer to "Do you intend to study
in US" be YES or NO ? ( my guess is YES, and name of the elementary school?)

Hi,

I need your help on this tricky (at least for me) situation. I am a Software Developer right now and want to chanfe my job to a PM (product manager), but within the same division, same employer. Apparently the job descirption of PM (like new product functional design...) will be different from the one of developer (like new product technical design, coding...).

Right now, my GC status is: PERMLC got approved Dec/2006. I-140 was filed on Feb/2007 and still pending. I-485/AP/EAD were filed on Aug/2007 and pending.

My questions are:
1) I know the AC 21 law, say after Feb 2008(180 days after my 485 filing) and if the 140 gets approved by then too, I can do ANY job change within teh same employer or even switch to another employer, is this true? Or, I still have to stick to the similar job type(SW developer in my case), no matter within a same employer or different one?

2) Before I can use AC21, say from now to Feb2008, I know I can not switch to another employer. But can I change my job to PM with the same employer. Will this affect my 485/GC case? If so, is there any solution or workaround so that I can change my job "smartly" without affecting 485?

I think mom's in the forum can answer this better since i am sure many of them took short term disablity during delivery and subsequent months. My wife took it twice for the birth of our children and I dont think it is an issue.

Here is the contextual description of my scenario:

I worked in a motel (while i was on F1) during the year 2007 and that salary was reflected on my W2. I maintained a clean work status after the initial transgression. I changed to H1B in the year 2008. My GC process was initiated and my application cleared the PERM and I-140 stages successfully.
My question is, will i face any hurdles during the I-485 stage because of the mistake that i committed while i was on F1 ((worked in a motel illegally)? If yes, how serious/low profile could the implications be?

Guys i have few questions and would really apprecite if you could help me the best of your knowledge.

1. I saw my 3 years extension of h1b has been approved. I am now thinking of going for stamping. Earlier i had been to canada for stamping as at that time getting appointment at indian consualte was difficult. How soon can i get at chennai consualte?? I heard for NRI's they give diferent priority ..is it true..???
Whats the website to schedule the appointment at indian consulate..???Is it dizyy to get stamping in chenna..???I have a US MS degree in CS.

2. My online status says H1B is approved and aproval notice sent. I shoudl also get an new I94 right..???there were few conserns for my attorney when we filed application..so want to make sure everything is proper before i start thinking of next step..(stamping and all).

I would really apprecite if you get share your views on my concern.

Your wife is fine. There is a CIS memo that specifically says that her H-4 status is not employer-specific. The only thing is that she will have a different expiration date to you. She would no get admitted for any longer than her visa, even showing your H-1B approval.

My parents are planning to go for a visa interview. What is difference between me inviting them to visit me versus they applying as tourists. I understand that if they apply as tourists they need to provide documents showing that they can support themselves.

Will coming as a tourist diminish the possibility of getting 10 year multiple entry visa. Any thoughts on this issue is much appreciated.

Tourists -> They support themselves financially during entire trip
Invite -> You support them financially during entire trip

The chances of getting 10 years multiple entry as a tourist is less likely, if they apply as tourists. Again, it is up to the I/O.
