hi all,

what is the priority date?there is an employer who filled perm for me in october 2008 and the perm was approved.i-140 was not filled.

The employer laid me off due to bad economy. Can i still claim october 2008 as my priority date?

Nope. You need to have an approved I-140.

Please update your case if you have applied on July 2nd at NSC and your case got transferred to TSC later..

I am in the same situation and last week I got my receipt numbers from TSC. No updates has been seen on my receipt numbers..

Thats ok even if she doesn't have AP. That is perfectly fine. Don't worry her H4 is already stamped and she has time till next year. She is totally safe even if she does not have AP.

It is 1 million reen cards every year. If you add up family based, lottery, asylum EB etc., it all comes to around 1 million.

Out of 140K EB green cards, only half the green cards actually go to high skilled immigrants. The other half go to the spouses and children of high skilled immigrants. So out of 140K, less than half of these green cards are actually allocated to the high skilled EB immigrants.

I am trying to figure out if it is possible to sponsor (legal sponsorship support letter) my cousin back in India who is trying for higher studies in Canada (the letter to be shown to the Canada consulate). I am an Indian on H1B in US with Perm just filed.

I heard that being a resident alien myself (as opposed to permanent resident) I cannot sponsor him? Is that true?

If I can in fact sponsor him -- will that have any affect/complication whatsoever on my (i) Perm (ii) Tax application etc etc?

He is an 18 yr old Indian.

I am currently on a H1 & I sponsored my Brother's education in US last year and i think it is possible. It doesnt matter whether you are a Resident Alien or a Permanent Resident. All they want to see is whether there is an ability to pay the tution fees and support his living expenses. There shouldnt be any problem. Let me know if you need more info.

I am on H1 and may have to use EAD in couple of months. What would be the status of my son (he is on H4) if I use EAD? We filed 485 in July 2007.

If you filed for I-485 for your son as well then he is in Adjustment of Status (AOS), otherwise he may be out of status once you start using your EAD. Talk to an attorney if you have not filed for AOS for your son and plan to use EAD.

I wondered why the top of the stamp design was rounded :) I think this would look better without the rounded edge. But the design itself is really good!

I sent her an email today to ask her to mail the originals and she refused.
"We usually keep the original receipts. " was her answer.

What to do? This is so frustrating. ARGHH!!!!
I know I have the right to ask for them but I want to keep it civil and not antagonize her. Is there any reason I can give her, like travel, to make her send me the originals without getting into a fight?

My I140 was originally filed at California service center, on 3/24/2006 it was transferred to Texas service center.

I was looking through my LC and 140 documents and found out that there are two different job titles in LC. One is Employer Job title which is "Analyst Programmer" other one is prevailing wages occupational title which is "Computer Systems Analyst". My question is what should be my Title at new employer?

Programmer, analyst programmer, developer, software engineer, sr. software engineer, sys analyst, etc., are all the same.

The gray area starts when a developer moves into business development or becomes a manager.

Since AC21 does not go in any official USCIS form, it is better to attach with G-28. My attorney did that and USCIS had acknowledged their receipt of the G-28 and supporting documents. The Ack was a letter to me and the attorney when my (new) attorney opened a service request inquiring the attorney of record after 4 weeks of filing G-28 and AC21 documents.

I have done stamping at Delhi some time last year January, me and wife attended in the same category, it was very smooth nothing much asked, even the lady who assisted us didnt ask for single document.

We were in the line early morning eventhough our time is little bit late (no body asked us about the interview time)...

If you are efiling EAD, you dont have to send photo graphs - USCIS will send FP notice to take a picture. That picture will appear on your EAD.

It is required that you send photos for your ead as they put your picture on the actual ead card. I did not apply for AP so I am not sure about the requirements for that. Good luck to you.

One way to deal with the maintenance ugliness, would be to cover it with a foreground object. That way it would feel like the whole bridge was in the picture. Just a thought, not sure how it would turn out.
