Wat would be the status of F1 student (OPT) mother of a US born baby after her visa expires, who is a single parent???

Mother will obviously be illegal. You should have no doubts about that!

Sorry to hijack your thread but I didnt want to start multiple threads on the same issue, along similar lines where can I find the actual law on H1B portability on I 140.
I have a offer but the immigration dept of the company says it cannot be done so I need to send them some documentation.

i know what you're talking about - this obsession w/pre-adjudication is ridiculous!i for one support dismantling the current vb based 485 filing lottery system that utterly makes no sense whatsover! let people file 485 as and when 140 is approved and get rid of this cynical vb based filing -

I am on h1-b visa and I have got an opportunity to have promotion in my current company. This new position is in the same department with the same company and needs almost same type of computer skill but with higher position title, more responsibility, and higher pay.

Question:
Do i need to file for new h1-b or transfer?

These aren't anything special, but I'm dying to post something while I try to make up my mind about what to do about getting my transparencies into the computer.

All taken with a Kodak DX3500, but I've not figured out how to do my edits in Photoshop without destroying the EXIF. :confused:

I had spoken to couple of Attorneys and they have told me that H1B will done with in two weeks this year. Therefore, anyone looking to apply, get your ducts lined up.. There is not much time left..

When to File.
Generally, a Form I-129 petition may not be filed more than six months prior to the date employment is scheduled to begin. Petitioners should review the appropriate regulatory provisions in 8 CFR which relate to the nonimmigrant classification sought.

wouldnt it be better to check the earliest apptt available on the INFOPASS website rather than here..Just a thought.

I might add that galbraiths site says that Kodak is dropping the digital backs to focus on making large sensors and develop high end DSLR's. Could be intersting.

I have a curious situation. I have filed EB3-485 as a secondary applicant to my wife. I am currently in a job where I can't file a green card ( this is my 5th year of H1b). My understanding is one can't have a seventh year extension for H1b unless his I-140 is approved.

Should I consider changing the job and filing another GC by myself. I know I can continue renewing EAD but I still want to keep my H1b

If you want to keep your H1-B beyond 6 years, I dont think you have any other option! You have to have your own LC>365 days or approved I140.

Do I need to provide any proof during the interview stating he is my step son? or the documents between the mother and the son will suffice?

his GC is approved, before he leaves the country take an infopass appointment and get I551 stamp on his passport for him to be able to reenter the country. if he will be out of the country for more than 6 months he might need a reentry permit as well.

Two yrs back my friend for a B1 visa thru his company and got the visa from the consulate for 10yrs. He never came to the US and left the sponsoring company and moved to Australia, the question is , Can he enter the US using his existing visa for tourism purpose ? or does he have to apply for a new one ?
I would greatly appreciate any help on this...

If you go for a permanent position, drug test & background checks are very common and also the process is very simple. Also it depends on the type of sector, for e.g if you go in medicare drug test is must, similarily if you go for financial majors, fingerprinting is common.

1. Send all AOS forms and proof of pregnancy from the doctor. They will issue RFE or you can send medical after the delivery. Don't take risk while on pregnancy. RFE reply will get 30-45 days time.
2. If your current visa is not expired, you can delay in filing I-485. Just file I-130 now.

My friend also don't have any issue. He filled on June 10th 2007 and has to leave county on June 12th 2007. He and spouse got stamping and came back to US on July 11th 2007. They have done FP and got EAD.

It's advisible to to have Receipt# before leaving and I am hoping you will get in next 8 weeks for sure. Good Luck.

I have I-140 approved and also based on I-140, I have 3 years H1B approved which expires in 2010.
My I-485 was rejected and I have re-submitted which is obviously pending and not further news on that (refiled on 10/10/07 at CSC)

I have following questions:

1. If I want to travel to INDIA for 6-8 weeks, Is there any problem?
2. Can I get H1B VSIA stampled at BOMBAY?
3. Do I need any other document except H1B approval notice & I-140 approval notice?
4. Do I need to mention about I-485 been filed?

Actually, that is not true. USCIS is part of US Govt. That is true. But, the department is run exclusively on the funds generated by receipt fees. So, they do have a responsibility towards us. dont you think
