Hello everybody,
I need some information. I am on h1b right now. My fiancee is in india and we are planning to marry in May. After that he will come here on H4 visa.
How can he apply for H4 to H1 transfer after comming here ?
and how long it will it take for H4 to h1 transfer......
when can he apply for h4 to h1 transfer , any time after his comming here or only in April month...
Please anybody reply me as soon as possible.

I once again plead with all members to meet law makers and send several thousand letters on this. Spending 45 mins on a letter (typing, printing, posting etc) may save 5 years of wait! Please think it over!!!

I do want every one to have easy access to GC. Here what you are asking does not serve any one. It only increase the backlog. If we could make them utilize unutilized visas, remove country cap, set a fixed time frame, for most part I-485 would be current allowing any one with approved I-140 to file for I-485. You might say that atleast they could get EAD and AP. But look at those who already have I-485 filed. We are all crying the our applications are there for long time. So, do you still think to have AOS even PD is not current??

You were one of the people who made it through the July 2007 fiasco. But, please understand that there are several people like me in the queue for more than 5 years but still missed the July 2007 fiasco. Getting EAD and AP is a great step forward for us and will level the playing field.

Have you tried Infopass.
If not you should schedule an appointment and try to find out what is going on. Also, see what else can be done to get your EAD approved.

Great Idea. Since this is Saralayar brain child, let us all nominate him/her to lead this venture , while us IV followers pursue more servile task's like trying to recapture visa numbers, get multi year EAD's and basically save our B*^$'s.
If this venture is a success Saralayar will be a citizen in a year (along with a few side kicks that are backing this new citizenship concept) or so and then he/she can push congress to pass the other minor legislation that will bail the rest of us out.

E-filed EAD on 24th April.
Supporting documents received on Apr 28th.
Received EAD receipt on April 30.
Last year I remember receing the receipt and biometric appt letter together.
Has anyone who efiled for EAD renewal this year have received biometrics appointment?

Yes, I did apply EAD renewal thru e-file on 4/26/2010. Rec'd FP for 5/20/2010.
I just went for a walk-in today(05/06/2010) and completed the FP(Code 2).
Waiting for the approval.

As another member said, please display the list of all members who paid.
Also, to all the registered members in IV, why dont we send an email as a gentle reminder?
The email can also include the list of members who donated/pledged to attend the event. That might motivate others to contribute atleast financially?

It is good to see the combined Immigration community efforts are bringing results. However, it appears that no attention is being paid to raise the issue of children ageing out because of visa t the benefit under CSPA.
I hope some one from Immigration Voice leadership team will take a lead to highlight such issues also before the law makers.

My elder son also aged out in 2005, and fortunately, we had Canadian PR Card by then and he had to move out of the country. He had completed his three years of college in US and when moved to Canada had to loose one and a half years of credits as Canada did not recognize all the classes he had taken in US..

What a waste of time and money due to this broken Immigration sytem..

I have been doing a lot of research about this online and have even heard from friends that if you transfer your H1 to H4 and apply again for H1, your new H1 application is not counted against the H1B cap. How true is it? Has some one done this before ? Is there any risk involved? Any help would be really appreciated.

Rep.Darell Issa (NY) has introduced a bill to end the Diversity Lottery program and give the 55k visas to EB applicants with advanced US Degrees. This is a pretty exciting development (at least to me).

I think this is a great starting point that we should all jump on to clear EB backlogs.

It is quite childish to create a new id every time you want to say something negative. Your message may be simple and straight forward, but it lacks the integrity or any trust worthiness.

This thread has gone anywhere. It could be simply because of the lack of EB3 I members participation. There is a definite lack of support from the vested parties and a few are discrediting this solution from getting traction and to top it all, I don't see any rational explanation against this. All I see is uncivilized personal attacks, self gloating and people who love to have fun at the misery of others.

As I said before, I will go ahead and do research on what we can do about it and use my years of invested social capital to see if I can do something about it. Once I get some thing substantially done, I will come here for support.

For the "skillz" person, I personally enjoyed your rants. I have/had chances to know personally and professionally many Stanford graduates, I believe they are not as much as fun as you are. :)

I believe in talking simple and straight. Well, EB3 friends have every right to work for their benefit. Nothing wrong with that. EB2 people should therefore unite and protect their interests too. EB2 group should unite and lobby hard to ensure that the current equation EB1 > EB2 > EB3 is not disturbed. After all, everyone is selfish when the pins are down.
