Is university h1 the same as non-proft cap exempt h1 or is it different ?

Its the same as a university comes under "Higher Education".

...if you do not have a valid-unexpired stamped US visa.

Does anyone know if I require a transit visa if traveling to India via Canada by Lufthansa.
I have a AP, used to have a Canadian visit visa which expired in Dec 2010.

I have traveled on AP via Dubai using United and did not have a issue.

I want to get my Wife�s name (FNU case) corrected in the L2 petition. What is the process for that? I have read that a Visa amendment needs to be filed but didn�t find any such amendment form on USCIS site.

She only had her first name in the passport hence both the petition and I-94 had her name as FNU HERFIRSTNAME. I am planning to get her name corrected in passport first by applying for a new passport at consulate. Afer that, need to get her name corrected in the L2 visa petition. I-94 should get corrected when we re-enter US next year as current one is already expired.

Has anyone got the visa petition corrected? Please let me know the process. Appreciate help from everyone.

so many complications, so many rules to know - we might as well be immigration attorneys!! we (or at least some of us) pretty much know more about the INS and immigration laws than the average immigration attorney :D

One has to maintain at least 6 months of validity in the passport if on H1
(for visa and for traveling); although not strictly implemented, this might create problems. Next, an expired passport is not considered to be a valid ID document.


Is there any problem if your passport is expired while on H1 visa?

Do we need to get the passport renewed before it is expiring?

Does I-140 have to be approved before using AC21? In my case, I140 has been pending for 1 year now, but got EAD recently.

If I use AC21 to move to a new job in 6 months, can employer pull out the I-140 ?

Any workarounds?

My H1 expires next week and I am having my FP date 11/13.My company HR recommends that I don't need to go for the 8th year extension.They say that it is a kind of money and time waste to go for extensions.They say that it is good to work on EAD.But my question is what happens if there is a pro with I485?What do you guys recommend????
Can you guys tell me the forms that have to be filled for H4 Extensions.I want to save the $$$that I have to pay for the attorney.

Well I have a BS and MBA with 1 year of experience in my current company. And they're not willing to do MBA+0. So I guess Eb3 is the only option.
Both degrees are from a US university.

Is there premium processing for I-765 which is t get EAD through marriage.

If you can go out of the country and return on L1 the new I-94 will take effect. COS should not impact, An attorney can advise better on this.

H1, H4 (spouse) and H4 (kid) living happily.

File 485 and gets EAD/AP.

H1 doesn't use EAD.

H4 uses EAD and hence looses H4 status.

I-485 is denied.

Now, my understanding is that spouse has to go out of country and come back again on H4.

What about the kid?

When does the kid loose his/her H4 status? (When both mother and father use EAD)?

As long as primary stays in H status any derivative who does not change his H4 status will stay in H4 status. the only way a H4 can loose H4 status if he/she uses EAD. In your case if i have understood it correctly ur Kid will never use EAD and if you never used EAD ur H1 status is active thus ur kids H4 is active .. also i think ur wife can change her status back to H4 but would require her to file some paperwork .. she might need to geta visa stamp when she tries to re-enter into us..

Hi-

I am applying for my EAD/AP renewal. The received date on my I-485 notice is Aug 2007. According to USCIS, if you filed after July 30 2007, you are not required to include a Fee.

I am looking at my receipt notices and I feel like I payed under the old fee structure and should include the fee. Here are the amounts
I-485 : $395.00
I-765 : $180.00
I-131: $170.00

Can someone please advice if I need to include the fee for AP and EAD renewal.

I think it is Aug 17th or afterwards and in new fee structure you do not have to pay for the renewal.

Can my current company continue my GC even if I transfer my h1 and join another company?

I-140 Approved - Jun 2008

Waiting for date to be current to file I485 and my current company is ready to continue the GC process even if I transfer my H1 to another company.

Your expert advise will really be a help for me to take decision on this , is it wise to change h1 now?

I have a appointment at calgary, canada for my H1 extension visa stamping. Any one has experience in Calgary.

My spouse entered the US on H4, she has a MBBS degree from india and she got H1 sponsored by a reputed university to do research.

I read on the posts that first time H4 to H1 stamping might pose a issue in canada if a person does not have degrees from US or Canada.

Please let me know.

If H1 for your spouse is already approved, there should not be any problem provided you carry all necessary documentation. If it is under processing (not yet approved), and you have your H1 approved, your spouse should not have problem for H4.
