--I suppose this year's quota for EB3 India is not yet used (as small it may seem). My guess is, when EB3 processing begins, it should get your collegues out in 6 to 9 months from now.

No, you will have file I-765 form with USCIS, you can do paper filing or electronic.

Please go through the stuff for the last one year plus from immigration.com on PERM processing, need to look at each entry in the diferenet excel sheets, it is not consistent from the data perspective (we all have our regular work too :-) ) so cannot pull up URLs for you, the above site is the pointer, please do your homework too :-) - Since you are really interested in specifics, appreciate if you can get this directly, it will take you couple of hours at the very least to get this data.

BUT FIRST I need to put the cup back in the kitchen. I start to head for the kitchen and look out at my balcony, notice the flowers need a drink of water because of the extreme heat. I put the cup on the counter and there's my extra pair of glasses on the kitchen counter.

I have an approved I-140 from my current US company but there are some discussions of "layoffs" going around and I want to be ready for any scenario.

My question is whether I can retain my PD with an approved I-140:

1.) If the employer hasn't taken any decision to cancel I-140.

2.) If the employer writes to USCIS about cancelling I-140.

Even CIR comes most pro immigrants groups will oppose. CIR will not have Guest workers program for low skilled workers because of high unemployment. So Business and pro illegal group will oppose. EB reform will be there in the CIR. But that will come with Grassley's restrictive bill on H1b. So, for that most high skilled group including IV will oppose. So CIR will be opposed by everyone. Status quo will continue till some compromise is reached.

When it is piecemeal people say we want comprehensive reform.
When it is comprehensive reform they say it is too broad to pass .
When it is summer they say Immigration Bill be introduced as early as Winter .
When it is winter they say it immigration bill will be introduced as early as summer .
When it is between spring(between winter and summer) they say now there is not adequate support for the bill.

This is a clear motive of hanging immigration reform like a bone in front of the dog and making him run around it and pay taxes .

Common sense is not so common.

I read somewhere that if I have a approved 140 and have already applied for 485 I can only get a 1 year ext on H1 and not 3 year. 3 year H1 ext beyond 6 years isonly for people who are not able to apply for 485 due to retrogression. Is that true? I want to maintain the H1 to be able to easily transfer n case I loose my job.

What I am looking for is how do they physically transfer the application? I am afraid of dealing with another incompetent organization such as USPS. Also, what type of processing delays should I expect?

How recent were the guidelines that I-485 be sent to the same center as I-140? Were these guidelines applicable on July 2nd.

I do not know about the guidelines but these FAQs were released a few days ago(definitely after July 2nd).

Your question about how do they physically transfer applications is just very stupid. Just think about it. Your lawyer made a mistake and you want to blame USPS or USCIS for it? Nobody can tell you for sure their method of transferring applications. I dont think you have any other option but to wait.

Don't forget, if you filed in PERM, your labor might be <365 days.

I'm confused - Everyone who has a 140 is supposed to have a Labor and very likely that will be more than 365 days old. So why do anyone need 140 approval in that sense ?

if you invest in foriegn stocks using a us broker you don't have to worry much. Your 1099 will have it spelled out. If you send money out of country you will have to report those earnins to IRS even though they might not show up in 1099.
