I got approval 2 years back. What I did is applied for EAD when my date is current in that months's bullettin. So they picked up my file and find my date is current, so they rejected my EAD application first and approved the GC. I have lost the EAD filing fee, but got a peace in mind (GC).

Try that route, to pick your file from the shelf. (black hole)

In your opinion, F1/F2/B1/B2 is not option to keep GC process alive.

I can not apply 485 if I am in India.

I have same question......if for example as above someone changes to SAP....what should be done in terms of notification to USCIS..?

Do we just go ahead and join the new job / consulting firm and get a letter from them to match the O*NET code or description as above...?

if you don't inform in advance and incase your old employer inform them , who will get REF..... everthing seems unclear to me as far AC21 is concern...

any authentic document on AC21 releated to job change and promotion?

I spoke to Cigna (I have Cigna access plus). As long as claims are for preventative care, Cigna will reimburse. Vaccinations, Tests and X-Ray will be covered. I intend to file a claim, let's see whether I get anything.

My EAD expires on - 10/10/2008. I had e-filed on 10/01/2008 for renewal.
I-140 approved. I 485 peding since Aug 2007.

Should I continue working after 10/10 as my current EAD will expire. Can I use my e-field receipt notice to continue my employment ?

This is what my lawyer says about mergers:

If your job (description, location and salary) remains same or similar under the new company:

If the 485 has not yet been filed, you are required to amend the 140. You can file amendment and 485 together.

If the 485 is pending, in most cases do nothing. After 180 days, you are safe, anyway.

If your job has changed :

If 485 has not been filed, you are in trouble. You have to start the green card process over, but you keep your priority date if 140 is approved.

If 485 is pending for 180 days, the jobs need only be similar.

My case is totally different. We applied on July 2nd and my wife got her EAD last week but my EAD not yet approved. Is it normal?

Could someone having experience with self EAD renewal, please provide, application form #, documents needed for EAD renewal, and fee. I would like to do it myself.

That is true but I want one of them to be rejected and by not responding to FP and stopping payment on checks I am trying to exactly that.

Can you please explain why E-verify is going to badly affect a legal employment based GC applicant? I was thinking that this is good for most 'legal' people.

USA which is a so called developed country, takes 6 months to issue a passport due to the fact that USCIS is over...........loaded with work. So Flashing story is an old one and will only fit in Hollywood world.

The US Department of State Bureau of Consular Affairs issues a US passport to eligible citizens. Applying for passport and issuance is not a USCIS affair and hence is a lot faster i would say a month or less at most ! Had it been a USCIS affair.... most americans will still be tracking their passport case status online ! :)

This way everyone running out of the 6 years on Visa can actually use this route to have a total 11 years without filing the I-485. Moreover if this is true, everyone can have the backup H1B from any company in case they loose the jobs they can have the backup H1B to stay in status in the country. Now the other thing from that arises is if the main H1B is terminated on Layoff, which LCA will be in effect for salary condition.

I can work in the Software company fulltime but at the same time can work in a motel parttime, now when I get lay off from the software company ..I'll be in status but working for motel, also not full filling the condition of Highly skilled labor etc.

Can someone please explain all this. So far I know you cannot have this and this is what my attorney told me when I thought of doing that to open up a company and work as an employee partitme in it.

YES, you can have another H1. It is considered as a concurrent H1 or part time H1. You may work on it without any issues once you get it.
It would be a seperate case.

It should not have any effect on your current H1 or 140.
