Yahoooooooooooooo......We (Me and my wife) received welcome notice today . Our 485 is approved on 25 th March.

no updates online just received postal mail from USCIS today .

I guess end of long wait , been in country from 2001 .

I wish you all the best and hang in there if your PD is current you can expect the notice any time so keep checking your postal mail box .

FYI - I dont know if my back ground check is clear or not , I guess it is .

6. If you have problems related to your enrollment with your current school and have not yet been accepted for transfer by a new school:
a. Contact SEVP immediately by email at SEVIS.Source@dhs.gov if:
• Your school discontinues the classes/instruction for which you have contracted
• You are unable to contact school officials
• Your school officials will not assist you
Note: Students from the same school and acting as a group may provide a single report to SEVP about your situation.
b. Provide SEVP the following information:
• Family name
• First name
• SEVIS ID
• Date of birth
• Form I-94 number
• Contact information, including mailing address, telephone number, and email
• School name and address
• Date you became aware of the problem
• Description of the situation (a summary; 1-2 paragraphs)
c. SEVP will assist you if you choose to enroll at another SEVP-certified school. However, the basic requirements for you to transfer or depart the United States remain the same as for all students, whether or not their school officials are supporting them.

If you are serious about discussing issues like this, I would suggest you take opinions/bias out of your arguments.

All of your below listed biases are classic anti-immigrant groups' slogans.
"unskilled/low skill immigrants cause higher unemployment", "unskilled/low skilled immigration == jobs not created, remain uneployed", "DV / Family based immigration brings in unskilled/low skilled immigrants"

If you want a healthy discussion, do some research and provide data to support your assertions or ask for data before you make assertions. This thread will quickly turn into a bash fest against so called "unskilled" workers.

And, how do you define "unskilled/low skilled" ? as compared to what ? A Java programmer ?

I agree as well as dis-agree.

numberUSA give this argument for all the immigration communities which I am sure is from a different perspective (xenophobic or race). They just don't want any immigrants no matter what.

I am talking only about this crisis and merely from economic point of view. About choosing based upon what is good for the economy and what is not.

My sincere advice - if u are here currently on a visa then forget about applying for GC..! Complete your education and get ur degree. Then - PACK UR BAGS AND GO TO ANOTHER COUNTRY OR just go back home.! This GC is bussiness is honestly not worth it anymore.!! Sorry if i sound frustrated or disheartening but I'm only being practical & realistic.!

Company A in my case has not revoked my H1B, it's still in valid status. I had been to India too & I came back with same VISA on MARCH 12 2009. I have mentioned in the post also.

I have my Labor and 140 approved. (140 approved in Jan 2009)
But my employer is not ready to provide me with copy of my approved PERM labor and 140. Just like any other employer.
So I am planning to request both of this by making FOIA request to DOL and USCIS.
I have done some ground work for that. Now here are my questions.
1) If I haven�t applied for 485 yet will USCIS/DOL release this document to me?
Or are both of this employer�s petitions?
2) I have heard that after six month of 140 approvals it become employee petition.
How much true is that?
If anyone like me (who haven�t applied 485 yet) got their copy of labor and 140 through FOIA. Please share your experience.

I have a unique problem with possibly getting a green card too early. Please let me know how I can make this situation better. My priority date in EB2 India is in Jan 2006, which means potentially I could get my green card in 2-3 months.

I plan to get engaged in December 2008 and married in December 2009 to an Indian born Australian citizen. As far as I can see, her chargeability would be from India.

What are my options to make my life easier and to be able to successfully bring my future wife to the US the easiest possible way. So far, I have 2 options:

1. Use the special E3 work visa for Australian citizens.
2. If I dont get my GC within the next few months, do an early court marriage and invoke the following-to-join spouse when she is ready to come to the US.

If you follow #1 while you will have your GC immediately your wife will need to maintain her E3 visa until your PD is current again.

Kindly inform your friend that uscis is just accepting application for skilled workers at the moment.

You may be right on that.

But the real question in this case is will the person be subject to yearly cap (lotter system) or be considered as a H1-B transfer kind.

she can apply for H4 when you visit India, as long as you maintain H1. she does not have to wait for H4 COs to be approved. In fact she does not have to file for one.

The requirement is that to reenter she needs to have H4 stamped to enter with receipt of I-485 in lieu of AP, not when she leaves because as soon as she leaves the country the status is gone. A status is valid only while in USA. In fact COS will not give her a stamp and since hers is H4 and you have approved H1 she doev not need approval from USCIS for that.

If the case had been different, she was applying for H1 then she would have needed an approved petition first.

If it is approved don't wait for the actual paper to arrive. You can apply 140/485 right away and USCIS will contact DOL for your LC papers. That's what I am doing. Don't wait just apply!

Well...This is called "Heights" or "Crossing the limits". Now come on...a friend who has helped u a lot in the past, but cannot(or will not) make it to DC for whatever reasons, u r gonna cut ur relationship with him??? I agree although absolute aim is getting GC , But It is too vague to put as a clearly defined objective.

Whereas asking for "current Priority Date for every category above EB3" clearly defines our goal.I think categories below EB3 is beyond the scope of this forum.
It is more complicated/different and there are forums which knows the issues clearly and are adressing them

We need to work towards all category of Employment Immigration like EB1, EB2 and EB3. Apart from other priorities including getting GC as early as possible, our top priority is applying I485,AP & EAD for all categories when they are not current.

DPSG: Again do not post any messages like for only EB2 or EB1. It has to be all EB categories.

Hey, with ALL EB numbers gone till October, what else USCIS employees are suppose to do? Poop, Pee and approve I-140! This way, make this freaking GC line even longer.... my 2 cents....

I believe USCIS has more work than just EB - they do have have FB cases too and certainly the backlog in FB is still many times longer than EB.

Not that I am saying we are better off or worse off - just wanted to point out that USCIS employees do have something to work on regardless of EB numbers available or not. Also EAD and AP processing goes on regardless of whether EB numbers are there or not.

Please do not assume that no work is being done and belittle the jobs of those who work at USCIS.
