What is the reason behind you saying 'case may be audited' for the OP. Just curious to check your side of thoughts.


If your title falls under Job Zone 4, you can still apply for EB2. However, there is a possibility that your case will be audited.

Hope you don't mind me messing with this a bit, but sometimes it's easier to do it in photoshop than to explain with words what could be different. View the attached thumbnail (click on it for fullversion) to see how a slight change in the position of the elements could affect the photograph (the "ZING" as Lecter calls it ;)).

You did, however, pick a good time of day for your photo. Too early and the plane might be even darker with no detail, and too late and the moon would have to be overexposed if you wanted the rest of the picture to look like it does now.

My GC finally recently got approved and have following questions:

• If I don’t work for my current employer for at least six months after the approval, what kind of issues comes up when applying for citizenship later. What is the law.

• Do we have to submit six months paystubs or yearly W2s.

I had the same case. My attorney refused to tell me the case number for my labor because according to him my application was owned by my company and they didn't want us (applicants) to know our case numbers. I tried looking for any alternatives, but nothing worked. As few people suggested me, try contacting BEC directly.. and may be they'll send you some snapshot or something, but i guess even if they do.. they'll send it to the attorney, not to you directly.

Neway, finally I got my labor certified last month.

So now they have a backlog for updating processing dates......cool......

I have a valid H4 stamping till Sept 2010. I got my H1B approved last year(2009) and COS from H4 to H1 approved. My H1B was effective October 1, 2009. Due to recession, I still have not been able to find a job. Now I want to change my status back to H4.

As I have a valid H4 stamping on my passport, can I travel across the border to Mexico, surrender my H1B I94 and reenter the US with a new H4 I94? Is that possible? Can that be done on the same day? Or should I apply for a COS - Form I539 and get it done here?

Please respond at the earliest.

I was in a similar situation as you and had to use this firm. H1B filing experience was fine but the entire GC process and filing was not a good experience at all. There were days I had to call the paralegal and teach him the new immigration laws and that's never a good sign ! Because of their mistake I was stuck in Eb3 rather being in Eb2. May be they will deal differently with your case but have a chat with them and your company managers before you agree to use them. I m with another company and another attorney firm and they are awesome !

Yes you can do this...just call the embassy....Indian ambassy is pretty fast....to help on this...
