Hi,
My wife's H4 visa got expired in jan 2008 and I renewed her I-94 and I-94 got extended till 2010.
Next week she is travelling back to India throgh Lufthansa airlines from portland to Frankfurt to Chennai. Some people are telling that getting transit visa in Frankfurt airport is difficult if visa stamping got expired eventhough you have valid I94. Is it correct?

I have two questions here.
1 Is really transit visa required, as just she needs to catch another flight in other terminal in the same airport?
2. If transit visa required will it be problem if her visa stamping got expired ( But she has vaild I797 and I-94 documents ).

Please help me by answeringthese questions.

I am travelling to INDIA on Jan 28, 2009.

I am booking Lufthansa Airlines, travelling via Munich to Delhi.

Visa on passport is expired but I do have approval of H1B till 2010.

Do I need transit Visa? Did anybody travelled this route lately? Do you knowbody who has expereinced this lately.

TWOV (Transit Without Visa):
Visa required, except for Those transiting to a third country
by the same or first connecting flight without leaving the
transit lounge. Warning: Transit only possible at Frankfurt,
Munich, Hamburg and Dusseldorf Airports, see conditions below.

- Nationals of India may use the TWOV facility mentioned
above if holding a residence permit for U.S.A.. (SEE NOTE
5151)
NOTE 5151: This TWOV facility also applies for the return
travel provided it is one journey and return travel has
been commenced on or prior to the expiry date of the visa
or residence permit.
- Nationals of India may use the TWOV facility mentioned
above if being admitted for residence in the U.S.A.,
holding Authorization for Parole of an Alien into the
United States together with a national passport endorsed
with I-551 stamp AND:
- travelling to/from the U.S.A.; or
- travelling to country of nationality. (SEE NOTE 5151)
NOTE 5151: This TWOV facility also applies for the return
travel provided it is one journey and return travel has
been commenced on or prior to the expiry date of the visa

- Conditions: TWOV available, provided passenger:
- is properly ticketed with a confirmed reservation for the
connecting flight; and
- within 24 hours, through Frankfurt, Munich; OR
- on the same day between 04:30 and 23:30 through Hamburg;

- on the same day between 06:00 and 21:00 through
Dusseldorf, (inbound carrier must provide prior notice to
authorities by fax: +49 211 421 37100 or SITA Telex
DUSOVXH).
And:
- is arriving and departing from/to non-Schengen country;
and
- holds all travel documents required for entry into
country of destination.
Additional Information:
- Visitors must hold visible means of support, onward/return
tickets and/or other documents required for next
destination.

I was told if you have valid stamping you do not need get new stamping even if you changed the employer. All you need is to give the new approval notice at the POE.

am I missing somthing here.

That is true, and I know a lot of people who did that including my wife in 2006.

Most probably this is just an eye candy for us, to be eaten and excreted. But, I hope I am dead wrong!

I had to go through secondary inspection which took about 20 minutes at JFK.IO only verified and stamped AP. No other documents were requested. To be on safe side, I carried Pay Stubs, Education Documents and Office Identification card.

I know a case where i-140 was deniied similarly. If you dont really trust the attorney, as it looks to be the case, CHANGE the attorney 1st. Go to a big firm like Murthy.They handle cases like this & in my fren's case, it was successfully cleared using MTR in less than a month.
Make sure you have all the documentation needed for ATP and they ask for 1 out of 3, but if you can get more than that, its good.

I thought that manager control rule is for L1 visa, where consultant must work only at direct client site.

It is part of new employer - employee relationship memo. One of my friends has been working for 3 yrs at US Company via 2 layers of vendors. He went for stamping at Delhi 2 months ago. During the interview he was told that his visa has been approved - however a week later his passport arrived with visa denied.

our case was recvd by uscis on July 23. we got our EAD card, FP notices , 485 receipts already. But 485 status is not online yet. I really dont need to worry about it, but was wondering if anyone is similar situation..

I had this discussion with my lawyer. This lawywer has been touch with USCIS very closely and understand the process and how the system works (to the best possible for an outsider) and here is what has to say about LUD.

Most I-485 will be adjudicated without any LUD at all. This is an because even today it is the physical file that is being delivered to an IO. IO will not touch the system if there had been no issue or no infomation to update.

If one is getting LUDs on any application, it most likely implies that some information is being updated. LUD most likely are for some reasons.

The process of adjudicating a 485 is multi step with many department involved. When the file reaches an IO for the decision , it is expected to be complete in every respect. If IO has any follow up question or any comments, she would then enter in the system that we se as LUD.
Thus, LUD in most cases ( and not all), if at all, is a potential indication of further delay..
I am not aware of any concrete reason for LUD on an approved I-140. My discussion with USCIS indicate that it may be due to updating of company specific information and not necessary related to individual case. Internally the the system recognize each company by a specific number.

Regarding your question LUD on AP, it should be unrelated to 485 as it is handled by a different department and lower level officials.

Most of ABCD Lawyer are like that only :), there are good in filing new cases but not good at suggestions.

My online status changed from approval sent to pending. Did you any further update?

My attorney received an email notice of I-140 approval (PP) on Mon, June 25. But the online case status showed the application as pending. Finally,today my attorney called and was told that due to "system glitch ", approval notices were sent out in error!! It seems this has done to others too!!
Did anyone else encounter this?

My perm was approved a couple of weeks back and we are going to file the 140 pretty soon. In the mean while I had a question regarding the educational equivalency issue I see during this stage. The perm is for EB-2 which requires a Masters Degree( Foreign Degree acceptable). I've a Bachelors from UK which is 3 years and a Masters from UK which is 1 year. During the I-140 process will there be a problem coz of this. Do we have to submit the Bachelors degree information even though the requirement is for a Masters?

You raise a number of issues for which there are no clear or certain answers. My advice would be to request the extension of H-1 status without submitting pay stubs, and in the event of an RFE, respond with evidence of your complaint about your previous employer. If your new employer needs you to start work within three weeks, premium processing would be required, and even then, if there is an RFE, the timing will be tight.

The new employer is a large company with strong financials in this market, so we expect the H-1 to be approved and we expect denial of extension of stay. If both are approved, the attorney who takes up this case will get a bonus from me.

If the H-1 porting to new employer is approved, but the extension of stay is denied, can I use the unexpired H-1 visa in my passport at the POE to enter the country and obtain a new I-94 based on the new H-1 approval notice? Is this permissible under immigration law?

I am currently holding L1 and B1 visa from a company A. Now some company B has applied for my H1 Visa. If I get H1b visa, does both L1 and B1 get cancelled.

I have got valid H1 and B1 (expires 2013) stamped. The consulate did not cancel my B1 when I went for H1. Again it depends on the interviewer, for few of my colleagues, they cancelled the B1 and issued the H1.

Yes. Its up to the VO to grant the period of stay. You could enter US even with one day left on the visa. Once you are on US soil, its I-94 that determines the duration of your stay (which has expiry date).

IMHO, that's a big risk as you will never know if the IO just gives for a month, 2 months or 6 months.

There is the risk of getting stuck in security processing if you apply for another visa as shared by another member.

For your friend's case s/he needs to weigh these risks and see which one s/he can take.

My luck is just not good w.r.t GC. Afte long wait my spouse finally had received her FP notice and is scheduled for her FP in couple of days. But today she accidently burnt her finger and that too right at the spot where we give the FP.

Guys , any suggestion as to what needs to be done. Should she still try to give the FP and see if it works. She has a big blister on her finger.

Yep..not to worry..just go there on the date of appt..they'll just ask you to come back when the finger heals...I cut my finger...officer made a notation on my form and asked me to come when it heals..I went after a month and got it done
